The
Wednesday, April 2, 1997 meeting of the Hamlin Township Planning Commission
was called to order at 7:30 PM by Chairperson M. McCarthy who then led
the pledge to the flag.
Roll Call:
Members Present: W. Abrahamson M. McCarthy, B. Matthews, R.A.Petersen,
M. Rodriguez
Members Absent: C. Miller, J. Voelker
Others Present: K. Lemke, S. Armstrong
The minutes of the 3/5/97 Planning Commission Meeting/Land Use Hearing
were accepted as amended under OLD BUSINESS to read "Junk
vehicles can be dealt with through the existing township ordinance because
the township adopted the BOCA Maintenance code, which covers this."
on the motion of B. Matthews supported by W. Abrahamson. All members were
in favor. Motion carried.

Old Business:
PUD - reviewed the Ludington Article 1000.4:2 Number of Dwelling
Units Permitted. No action was taken.
Garage Size - Michigan Township Authority has no scale of house
to garage. Stan Armstrong to research what size variances the Board of
Appeals has granted. No action taken.
Adult Businesses - reviewed the request of the Hamlin Township
Board to increase the setback requirements to 300' from the road and 1,000
ft. from a residence etc. and apply this to agricultural, commercial and
industrial districts.
A motion was made by B. Matthews to establish the setback requirements
as: 1,320 ft (¼ mi.) from an existing residence, a church, state
licensed day care facility, public library, public park, public educational
facilities serving persons age seventeen (17) or younger, an elementary
school, or high school; 660 ft. (1/8 mi.) from the road; 200 ft. setback
from the property line on each side, and apply this to agricultural, commercial
and industrial districts, supported by M. Rodriguez. All in favor.
Motion carried.
M. McCarthy made a motion to note that the commercial district
cannot meet these requirements at this time, and the industrial district
is comprised of one 80 acre parcel with one owner and poor access from
Meyer Road, supported by B. Matthews. All in favor. Motion carried.
W. Abrahamson motioned that an adult business must be located
at least 1,000 ft. from another adult business, supported by R.A. Petersen.
All in favor. Motion carried.
Adult Businesses - Article 15 is to be amended as follows:
add to 15.02 "C. Commercial District";
change 15.04 A. and B. to read "1,320 ft" from
residence etc.
add to 15.04 A. and B. "The establishment must be located
with a minimum 660 ft. setback from the road, and a minimum 200 ft. setback
from the property line on either side.
change 15.04 C. to "1,000 feet of any other adult entertainment
establishments."
"C" Commercial District - Article 12 is to be amended as
follows:
add to 12.02 "L. Adult Businesses."
New Business:
Dark Sky Ordinance - B. Matthews will contact the city of Petosky
for a copy of their ordinance, and present for consideration at a future
meeting.
Administering Township Zoning: Basic Guidelines For Citizens and
Local Officials (Extension Bulletin E-1408) was distributed to the
Board members.
Land splits - S. Armstrong mentioned that due to revisions in
PA 591, the Board may want to look at creating a zoning ordinance to deal
with land splits and subdivisions. No action taken.
There being no further business at hand a motion to adjourn was made
by R.A. Petersen, supported by W. Abrahamson. All in favor - motion carried.
The meeting adjourned at 8:27 PM.
The next meeting of the Hamlin Township Planning Commission will be
held on May 7, 1997 at 7:30.
