The Wednesday, December 4, 1996 meeting of the Hamlin Township Planning Commission was called to order at 6:05 PM by Chairperson M. McCarthy who then led the pledge to the flag.

Roll Call:
Members Present: W. Abrahamson, M. McCarthy, B. Matthews, C. Miller, R.A. Petersen, M. Rodriguez, J. Voelker
Members Absent: None
Others Present: R. Rodriguez, E. Chmielewski, S. Armstrong

The minutes of the November 6, 1996 Planning Commission Meeting were approved as read on the motion of R.A. Petersen, supported by M. Rodriguez. All members were in favor. Motion carried.

Correspondence:

12/2/96 fax from Progressive Architectural Engineering, Tony Groves, regarding proposed wording for possible amendment to Article 14 Section 14.05 C) Canal Construction.

12/2/96 Letter from Roger Anderson re: Zoning Amendments for Adult Entertainment and Mobile Home Overlay District.

Old Business:

The Board reviewed Roger Anderson's 11/4/96 correspondence which confirms that the "Right to Farm Act" does not affect the application of the "Township Rural Zoning Act" unless the township were to place unreasonable restrictions on farming operations.

Proposed Article 15 - Adult Businesses was discussed in terms of Roger Anderson's recommendation that: Section 15.01 include the statement, "while protecting children from the adverse impact of such cases"; that Section 15.02 state that "Adult entertainment establishments be located only in the following districts"; that the end of sub paragraph A of Section 15.04 include, "or and existing residence"; and that the definitions be made part of this Article 15, since they only apply to it. J. Voelker motioned to adopt, supported by W. Abrahamson. All members were in favor, Motion carried. A public hearing is required.

Members reviewed Roger Anderson's recommendation that Article 16 Mobile Home Overlay District include "K. No mobile home that is dilapidated or in a state of disrepair may be placed upon any property". J. Voelker motioned to adopt, supported by M. Rodriguez. It was carried by all. M. McCarthy requested a motion to adopt Article 16 - Mobile Home Overlay District. J. Voelker motioned to adopt, supported by C. Miller. Support was unanimous. Motion carried. It was recommended to the January Public Hearing.

The Board discussed amending Article 7 - "A" Agricultural, Rural and Open Space District , page 7-1, #7.02 Permitted Uses to include "H. Adult Businesses and I. Mobile Home Overlay District"; and Article 13 - "I" Industrial District, page 13-1 , #13.02 Permitted Uses, "H. Adult Businesses and I. Mobile Home Overlay District". The motion was made by B. Matthews, supported by W. Abrahamson. The board approved with M. Rodriguez opposed. Motion carried.

New Business:

The Board discussed the issue of Mr. Boden and Mr. Towns who have developed a plan to build a subdivision with a man made lake and construct a canal to gain access to Hamlin Lake. The DNR is inconsistent in such matters. Tony Groves of Progressive Architectural Engineering suggested that the Township create an ordinance prohibiting the construction of canals. Roger Anderson suggests that it may be seen as a "taking". The Board discussed the negative environmental impact of such a development. J. Voelker motioned to table until further developments, supported by M. Rodriguez. Approved by all, the motion carried.

R.A. Petersen requested the Board to write a letter of condolence to the husband of the late Mary Ann Yeck in recognition of the support and contributions she made over the years. The Board agreed.

The next meeting of the Hamlin Township Planning Commission will be a public hearing on the amendments to Ordinance 34 to be held on January 8, 1997 at 7:00 PM followed by the regular Board meeting. The Public Notices will be published Monday, December 9, 1996 and Tuesday December 31, 1996.

There being no further business at hand, B. Matthews motioned to adjourn, supported by C. Miller. All members were in favor. The meeting adjourned at 6:35 PM.
