The Wednesday, May 7, 1997 meeting of the Hamlin Township Planning Commission was called to order at 7:30 PM by Chairperson M. McCarthy who then led the pledge to the flag.

Roll Call

Members Present: W. Abrahamson M. McCarthy, B. Matthews, C. Miller, R.A.Petersen, M. Rodriguez

Members Absent: J. Voelker

Others Present: K. Lemke, S. Armstrong

The minutes of the 4/2/97 Planning Commission Meeting/Land Use Hearing were accepted on the motion of M. Rodriguez supported by C. Miller. All members were in favor. Motion carried.

Correspondence:

Two letters were received regarding the Dark Sky ordinance under consideration. Ruldolph and Winona Anderson, and Erna Sinn opposing any restriction of yard lights; Richard and Ruth James opposed to the abolishing of yard lights. Copies of the letters are attached.

Old Business:

Dark Sky Ordinance - B. Matthews presented a copy the city of Petosky ordinance and the Tucson, AZ ordinance for review, in addition to information from The International Dark Sky Association. The issues were discussed. M. McCarthy to contact REA for additional information on lights and lighting. The Board agreed to review the literature for consideration at a future meeting.

Adult Businesses - reviewed the letter by Roger Anderson regarding the overly restrictive amendments made at the last meeting and revisited the request of the Hamlin Township Board to designate the setback requirements to 300' from the road and 1,000 ft. from a residence etc. and apply this to agricultural, commercial and industrial districts.

  • A motion was made by B. Matthews to establish the setback requirements as: 1,000 from an existing residence, a church, state licensed day care facility, public library, public park, public educational facilities serving persons age seventeen (17) or younger, an elementary school, or high school; 300 ft. from the front and any road; 100 ft. setback from the property line on each side and the rear." supported by C. Miller. All in favor. Motion carried.
  • M. McCarthy made a motion to add PR District to Article 15.04 A supported by M. Rodriguez. All in favor. Motion carried.

    • Adult Businesses - Article 15 is to be amended as follows:

  • add to 15.04 A. "PR "
  • change 15.04 A. and B. to read "1,000 ft" from residence etc.
  • change 15.04 A. and B. to read "The establishment must be located with a minimum 300 ft. setback from the front and any road, and a minimum 100 ft. setback from the property line on either side or rear."

    • New Business: None

    There being no further business at hand a motion to adjourn was made by W. Abrahamson, supported by R. A. Petersen. All in favor - motion carried. The meeting adjourned at 8:50 PM.

    The next meeting of the Hamlin Township Planning Commission will be held on June 4, 1997 at 7:30.
