The Wednesday, September 3,  1997 meeting of the Hamlin Township Planning Commission was called to order at 7:45 PM by Chairperson M. McCarthy who then led the pledge to the flag.

Roll Call

Members Absent: B. Matthews, J. Voelker
Others Present: R. Rodriguez, S. Armstrong

The minutes of the 5/7/97 Planning Commission Meeting were approved with the following corrections "A motion was made by B. Matthews... 300 ft. from front and any road;" and "change 15.04 A. and B. to read� 300 ft. setback from front and any road" on the motion of R.A. Petersen supported by W. Abrahamson. All in favor. Motion carried.

The minutes of the 6/11/97 Land Use Hearing were accepted on the motion of C. Miller supported by W. Abrahamson. All members were in favor. Motion carried.

Old Business:
Interpretation of 19.02 (AA)
Roger Anderson, Township Atty., interprets "19.02 (AA) Small Farming and Truck Gardening Operation: The keeping, feeding, or confining of cattle, poultry, horses, or swine shall not be permitted within 100 feet of the boundaries of a recorded residential plat or within 100 feet of a residence or separate property unless such use preceded the construction of the residence or the recording of the plat" as follows: 100' from a separate property line is 100' from the property line. He also interprets 100' from a residence to be 100' from the property line. Amending the ordinance to clarify this will be considered at a future meeting.

Interpretation of 19.02 (AA) applied to 6/11/97 Hinkle Land Use Hearing
Roger Anderson determined that in the case of the Hinkle Special Land Use hearing that because of the applicant's reliance on the discussion and implications of the planning commission, the stipulation will be 100' from the residence on the north property. It will also be 100' from the property line on the south property until such a point that the property line and the fence (which will start at the east corners of the new barn for the back acres of the property) intersect (be it by actually meeting or by imaginary line). At this point it will allow the full width of the property (350 ft.) to be utilized by five horses.
 

Dark Sky Ordinance
M. McCarthy pointed out that lighting is addressed three places in the current zoning ordinance: Article 4 - General Provisions - 4.13 (2) Exterior Appearance; Article 13 - Industrial District - 13.10 (F.) Light; Article 21 - Site Plan Review - 21.05 (F) Exterior Lighting. Residential districts are not specifically covered. Board members are to review these for the next meeting and be prepared to discuss whether further regulation is warranted.

Article 4 General Provisions - 4.05 Accessory Buildings and StructuresC. Miller, at the request of the Zoning Board of Appeals, raised the issue of the 960 sq.ft. limit to garages and accessory buildings as being too restrictive. The ZBA finds that a large percentage of variance requests are for "oversized" accessory buildings. They question if this trend is an indication that the ordinance needs to be reviewed. The issue will be discussed at a future meeting.

New Business:

Article 12 - Commercial District - 12.02(A)
12.02(A) contains a clerical error whereby the stipulation that, "All items, with the exception of items such as firewood, bedding plants, fruits and vegetables shall be conducted within a completely enclosed structure." was omitted. This is to be corrected.
Signage
A discussion of signage compliance covered Courtier's Blueberry sign which is non compliant (and scheduled for removal); Hamlin Headquarters sign which is compliant; Real estate directional signs which are temporary and compliant.
Laman's Landing
Possible rezoning of the east section of the Heycoop property (Laman's Landing) from Residential to Campground or Mobile Home will be discussed at a future meeting.

There being no further business at hand a motion to adjourn was made by R.A. Petersen, supported by C. Miller. All in favor - motion carried. The meeting adjourned at 9:00 PM.
